Do you need a MIAMS or FM1 in FromeThe FM1 form is used to confirm whether mediation has been considered before applying for a court order related to children or finances. This form is part of the Family Procedure Rules and supports the principle that court should be a last resort after all other dispute resolution methods have been tried. 

 When is the FM1 Form Required? You need to complete the FM1 form if you are making an application to the court for any of the following types of orders under the Children Act 1989

•  Parental Responsibility Orders•  Orders Appointing or Terminating a Child’s Guardian•  Orders for Changing a Child’s Surname or Removing a Child from the UK•  Special Guardianship Orders

Mediation Information and Assessment Meeting (MIAM) – Before you can apply for these court orders, you must attend a Mediation Information and Assessment Meeting (MIAM). During this meeting, a mediator will discuss with you (and the other party if present) whether mediation or another form of non-court dispute resolution would be more appropriate for resolving your dispute

Completing the FM1 Form The FM1 form must be completed and submitted to the family court along with your application form (C1 or C2). If you have not attended a MIAM, you must provide a valid reason on the FM1 form

Exemptions There are certain exemptions where you may not need to attend a MIAM, such as cases involving domestic abuse or urgency.
