Mediation Information and Assessment Meeting (MIAM)

A Mediation Information and Assessment Meeting (MIAM) is the first step in the mediation process for family disputes in England and Wales. It is designed to provide information about mediation and assess whether it is a suitable way to resolve your issues. During a MIAM, a trained mediator will explain what mediation involves, its potential benefits, and the role of the mediator. They will also discuss important aspects such as confidentiality, the voluntary nature of mediation, and the fact that agreements are reached by the parties themselves, not imposed by a third party.

The meeting typically lasts about an hour and gives you an opportunity to tell the mediator about your situation and the issues that need to be decided. The mediator will then assess whether mediation is appropriate for your case, considering factors like power imbalances or potential risks such as domestic abuse. If mediation is deemed suitable and both parties agree, you can proceed with mediation sessions. If not, the mediator will sign a court form allowing you to pursue court proceedings.

Form FM1
Form FM1 is a document used to confirm that you have attended a MIAM or to explain why you have not attended one. If you decide to make an application to court to resolve an issue discussed at the MIAM, you will need the mediator to sign this form. The form is required to show that you have considered mediation before taking your case to court, except in specific circumstances where exemptions apply, such as cases involving domestic abuse.
